Will ducted heaters not installed to manufacturer's guidelines void my warranty ?

As you will see in the photo on this page the heater is installed with the hot flue gasses existing close to the wooden deck. The wooden deck has been scorched and is a potential fire risk. This is a photo of an actual job we attended. The heater was isolated and can no longer be used until the decking is modified.
